Terms & Conditions
These Terms and Conditions are an agreement between The Flow Company Ltd and you. By registering for or participating in this The Flow Co. Ltd Retreat/Event you confirm that you have read, understand and agree to these Terms. Terms may be modified at any time by posting a revised version on the The Flow Co. Ltd website here: Term and Conditions. By participating in the Retreat/Event, you agree to the latest version of these Terms.
1 Registration
To register for this Retreat, you must confirm in writing your wish to participate and pay a 50% deposit on receipt of confirmation from The Flow Co.
2 Payment
50% deposit payable on confirmation of booking.
50% balance payable 90 days prior to commencement
Note: If booking made within 90 days of commencement, payment in full required on confirmation of booking.
The Flow Co. Ltd reserves the right to cancel your registration without notice for failure to pay in accordance with these Terms. The Flow Co. Ltd is not responsible for any damages, direct or indirect, resulting from such cancellation.
3 Cancellation by You
Subject to law, if you cancel your booking, or fail or are unable to attend a booked retreat/event, we will retain the following cancellation fees:
Time before commencement date of retreat/event - Change and Cancellation Fee (% of full payment)
· More than 60 days - 0%
· 60-30 days - 50%
· Less than 30 days - 100%
4 Retreat Programme and Cancellation
The Retreat programme is subject to change. The Flow Co. Ltd may cancel the Retreat/Event at any time and may deny, limit or cancel a registration for the Retreat (including a confirmed registration) at any time. The Flow Co. Ltd is not responsible for any damages, direct or indirect, resulting from such cancellation. If The Flow Co. Ltd cancels the Retreat/Event or your registration, so long as you are in compliance with these Terms and any refund policy listed on the registration page for the Retreat, The Flow Co. Ltd will issue you a full refund of any Retreat registration fee that you have paid in accordance with these Terms.
5 Code of Conduct
You agree to behave in such a way as to create a safe, supportive environment while participating in the Retreat. You agree not to impact the Retreat or other individuals’ participation in the Retreat negatively by your behaviour.
6 Assumption of Risk
You acknowledge and agree that your attendance and participation in the Retreat is voluntary. You agree to assume the risks associated with attending and participating in the Retreat to the fullest extent permitted under applicable law. You will advise the organiser of any health and physical limitations or concerns ahead of the Retreat. You agree to hold the appropriate insurance for your travel and attendance at this Retreat.
7 Force Majeure
Our performance under these terms and conditions are subject to acts of god, war, government regulations, disaster, civil disorder, strike or other industrial dispute and any other circumstances which are beyond our reasonable control and which we deem (in our sole discretion) render the performance of our obligations uneconomic, impractical, impossible or illegal (‘Force Majeure Circumstance’). At any time during or after a Force Majeure Circumstance we may (in our sole discretion) elect to terminate this agreement by notice to you and refund any amounts paid by you, less our reasonable costs and expenses incurred in respect of your booking which we cannot reasonably recover.
8 Privacy
By booking with us you acknowledge that we will collect, use and disclose your personal information (including to our third-party service providers) as we reasonably require to provide the service to you, and for other reasons permitted under privacy laws (including direct marketing). Retreats will be documented in photos and content used on social media and in marketing and publicity material during and after retreats.
9 Governing Law
These terms and conditions shall be governed by the laws of New Zealand and the parties submit to the jurisdiction of the courts in New Zealand.
